The Lobbying Disclosure Act of
1995
The Pennsylvania State University Policy Regarding
Contact with State and Federal Officials |
As you may be aware, the University policy concerning employee
contacts with state and federal elected, appointed, and career officials
both in the executive and legislative branches requires the Penn
State employees consult with the Office of Governmental Affairs
before contacting these officials on a particular issue on behalf
of Penn State. A copy of the University's policy is available in
my office for your reference if needed. With the passage of the
federal Lobbying Disclosure Act of 1995, it is now more important
than ever that any lobbying efforts on behalf of Pem State be coordinated
through the Office of Governmental Affairs. Generally, the Lobbying
Disclosure Act requires the University to track and report certain
contacts with federal officials made on behalf of Penn State.
The University currently employs two individuals who are authorized
to engage in federal lobbying efforts on the University's behalf.
As required by the Lobbying Disclosure Act, these individuals have
been registered as lobbyists employed by the University. In addition
to registering lobbyist employees, the University is required to
report lobbying expenditures of all employees incurred on Penn State's
behalf. Therefore, it is important that any lobbying activities
undertaken on behalf of Penn State be centrally coordinated through
the Office of Governmental Affairs. Only by adhering to a system
of centralized effort and coordination will the University be able
to meet its reporting obligations under the Lobbying Disclosure
Act.
In light of the above, please understand that any lobbying contacts
or activities made by University employees without the knowlcdge
of the Office of Governmental Affairs could jeopardize the University's
efforts to comply witb the Lobbying Disclosure Act and may result
in the imposition of fines upon the University.
On occasion, employees other tban the University's registered lobbyist
employees are encouraged to engage in lobbying efforts on Penn State's
behalf. Any ernployee requested to do so will be provided with tbe
appropriate forms that must be completed in conjunction with any
University lobbying activities. The University's approach to compliance
with the Lobbying Disclosure Act is in no way intended to limit
the right of employees to present their views to government officials.
Rather, tbis letter is to stress to all University personnel that
lobbying efforts on behalf of Penn State may only be made after
prior consultation with the Office of Govemmental Affairs. Should
you have any questions regarding past, present or intended future
activities which may be considered lobbying efforts on behalf of
Penn State, please contact the Office of Govemmental Affairs for
appropriate guidance.
